Welcome to Famlify

These Terms of Service ("Terms") govern your access to and use of the Famlify mobile application and related services (collectively, the "Service"). By using Famlify, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

1. Account Registration and Eligibility

Eligibility

• You must be at least 18 years old to create a Famlify account
• You must provide accurate and complete information during registration
• You are responsible for maintaining the security of your account credentials
• You may not share your account with others or allow others to access your account

Parent/Guardian Responsibility

As the account holder, you are responsible for:

• All activity that occurs under your account
• Your children's use of the Service
• Ensuring your children use the Service appropriately and safely
• Monitoring the content and activities within your family's account

2. Acceptable Use

You agree to use Famlify only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the Service for any illegal or unauthorized purpose
• Violate any local, state, national, or international law
• Infringe upon the rights of others, including intellectual property rights
• Upload or transmit viruses or malicious code
• Attempt to gain unauthorized access to the Service or related systems
• Interfere with or disrupt the Service or servers
• Use the Service to harass, abuse, or harm others
• Impersonate any person or entity
• Collect or harvest information about other users without consent

3. Subscription and Payment Terms

Free Plan

• Famlify offers a free plan for up to 2 children with limited features
• We reserve the right to modify or discontinue the free plan at any time

Paid Subscriptions

• Subscription fees are billed on a recurring basis (monthly or annually)
• Subscriptions automatically renew unless cancelled before the renewal date
• You authorize us to charge your payment method for all fees owed
• Price changes will be communicated at least 30 days in advance
• Refunds are provided at our discretion and according to our refund policy

Dad Bucks

• Dad Bucks are virtual currency used within your family account
• You can fund Dad Bucks accounts and set up automatic transfers
• Dad Bucks can be redeemed for real money according to your family's settings
• We are not responsible for disputes between family members regarding Dad Bucks
• Unused Dad Bucks remain in your account until used or your account is closed

Cancellation

• You may cancel your subscription at any time through the app or account settings
• Cancellation takes effect at the end of your current billing period
• You will retain access to paid features until the end of the billing period
• No refunds are provided for partial billing periods

4. Intellectual Property Rights

Our Content

The Service, including its original content, features, and functionality, is owned by Famlify and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our express written permission.

Your Content

You retain ownership of any content you create or upload to Famlify (quest descriptions, photos, notes, etc.). However, you grant us a limited license to use, store, and display your content solely to provide the Service to you.

5. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• That the Service will be uninterrupted, error-free, or completely secure
• That any errors will be corrected
• That the Service will meet your specific requirements

We do not warrant that the Service will be available at all times or that it will function properly on all devices or platforms.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FAMLIFY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the Service
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the Service
• Any bugs, viruses, trojan horses, or the like that may be transmitted through the Service
• Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content

In no event shall Famlify's total liability to you exceed the amount you paid to Famlify in the twelve (12) months preceding the claim, or $100, whichever is greater.

7. Indemnification

You agree to indemnify, defend, and hold harmless Famlify and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another.

8. Termination

We reserve the right to suspend or terminate your access to the Service:

• For violation of these Terms
• For any conduct that we believe is harmful to other users or to Famlify
• If required by law
• At our sole discretion, with or without notice

Upon termination:

• Your right to use the Service will immediately cease
• We may delete your account and all associated data
• You will not be entitled to any refund of prepaid fees
• Provisions that should survive termination (payment obligations, disclaimers, limitations of liability) will remain in effect

9. Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of [Your State], without regard to its conflict of law provisions.

Arbitration

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive your right to a jury trial and to participate in class action lawsuits.

Exceptions

Either party may seek injunctive relief in court for intellectual property disputes or violations of these Terms.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the app. Your continued use of the Service after changes are made constitutes acceptance of the new Terms. If you do not agree to the new Terms, you must stop using the Service.

11. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Famlify regarding the Service.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms at any time without notice.
